I bought a 2 bedroom apartment intram in hills golf resort… which i paid a depsoit of £50,000GBP and havent not received any money back. Will i be a bale to get my money back?

Dear Gill,
We are very sorry to hear that.

Hello Margaret,
Depending on the developer we can win the deposit paid if there were bank guarantees and we can also claim to the bank to where you transferred the amounts to the developer if the bank account was owned by the developer.
In most cases, legal fees are won and you will not have to pay any legal fees for laywer nor court representative.
And interests are also acknowledged since you made the payments to the developer.

Under Ley 57/68 I believe that I would receive a return of my deposit in full and
all interest on this amount. A deposit of 30 K Euros was paid (via Spanish Bank) on apartment and due to years and years of delays I cancelled this Contract.
Is it also true that the Court will order the Bank to pay all of Lawyer’s Fees and that the clients will not be required to pay any further amounts to Lawyers out of returned Bank Interest to client . Thanking you

I lost lots of money in Spain, and now find it hard to find funds to pay for legal action. My first solicitor turned out to be a very expensive one. He won a case against the developer but no funds were paid to me after I won the case. I had to find money to pay the expensive aolicitor…and then I had to move the claim to another solicitor because the first one simply kept milking me of money The developer some years later wanted to negotiate the court cost and interest…I had to go to court agaimst the bank in the end. So despite wimning the case the financial loss still annoys me. I know people who never claimed their deposits back because they felt that the Spanish leogal system is against them.

I’m looking to evict a tenant in Spain, he hasn’t paid rent for over 2 months 800 Euros and owes 1600 euros on electric water and community charges.

We can deal with this case and file a criminal claim against the driver and claim the insurance.
We guess that there was a police report of the accident and that the police is already dealing with this.
We will be able to take action against the driver and make him/her pay for all the damages and injuries caused to your brother.

In Spain, the compensation for car accidents is established depending on the days spent at hospital, days recovering/healing, long-term physical damages/injuries etc.
Once we know the full extent of the damages, we will be able to inform you about the approx. compensation that we could claim but with the information that you provided, it will be a considerable compensation.

You should have copy of the rental contract and also evidence that the tenants have not paid. If there are any unpaid bills for water or electricity you can claim that too. You will not need to prove if you are the owner (with title deeds) of the property. The process is very simple and takes from 2 to 4 months to be solved, but this will depend on each Court.
The Court will ask the tenants to pay the debt and if they do, the action will be annulled. If they don’t pay and don’t contest the eviction claim, the Court will order the eviction of the tenants almost immediately.
