Inheritance Scenarios and Legal Procedures

Each inheritance case is different. Depending on the circumstances, one of the following three legal scenarios will apply in Spain.

1. Inheritance with a Valid Will

If the deceased left a valid Spanish or foreign Will and all heirs agree, the inheritance procedure is completed before a Notary in the area where the assets are located (for example, Alicante or Torrevieja). The process involves submitting the Death Certificate, the Original Will, and the Grant of Probate (or equivalent). The Notary then prepares the Deed of Inheritance Acceptance, officially transferring assets such as real estate, vehicles, or bank accounts to the heirs. This is the simplest and fastest procedure.

2. Inheritance without a Will (Intestacy)

If the deceased did not leave a Will, heirs must obtain a judicial or notarial declaration of heirs. This requires various documents from the deceased’s country of residence, such as birth, marriage, or death certificates, all translated into Spanish and legalised with the Apostille. Once the heirs are officially recognised, the inheritance is processed in Spain as usual. 3. Inheritance with Disagreements Among Heirs
